Terms of Service

These Terms of Service ("Terms") govern your access to and use of the GroundView Pro jobsite-reporting service, including our mobile app, website, and SMS messaging program (collectively, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
GroundView Pro helps construction companies collect daily jobsite updates, photos, and notes from their crews — primarily through operational text messages — and organizes them by project and date.
2. Accounts and Eligibility
- The Service is for business use by construction companies and their authorized team members.
- You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
3. SMS Messaging and Consent
The Service sends operational text messages to crew members to collect jobsite updates. By entering or saving a crew member's phone number, the company represents and warrants that it has obtained that individual's consent to receive these messages. Consent may be provided verbally, in writing, or through the app.
Recipients can reply STOP to opt out at any time, or HELP for assistance. Message frequency varies by jobsite settings. Message and data rates may apply. The company is responsible for ensuring its use of the messaging program complies with applicable laws and carrier requirements.
4. Acceptable Use
You agree not to use the Service to:
- Send marketing, promotional, or unsolicited messages;
- Message individuals who have not consented or who have opted out;
- Violate any applicable law, regulation, or third-party right; or
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service.
5. Subscriptions and Billing
Paid plans are billed on a recurring subscription basis through our third-party payment processor. Plan tiers, pricing, and active-jobsite limits are described at sign-up. Trials, if offered, convert to a paid subscription unless canceled before the trial ends. You can manage or cancel your subscription through the billing portal; no contracts apply and you may cancel at any time, effective at the end of the current billing period.
6. Customer Content
You retain ownership of the photos, notes, and other content submitted through the Service ("Customer Content"). You grant us a limited license to host, process, translate, and display Customer Content solely to provide the Service to your company.
7. Service Availability
We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. Message delivery depends on carriers and other third parties outside our control.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
9. Limitation of Liability
To the fullest extent permitted by law, GroundView Pro will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising out of or related to your use of the Service.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if these Terms are violated or as needed to protect the Service and its users.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance.
